Fixr, Inc. DBA HowMuch.net (referred to in this Privacy Policy as “HowMuch.net,” “we,” “us,” and “our”) is the sole owner of the information collected on www.Howmuch.net. This Privacy Policy describes how we handle your personal information for our services on all pages of the HowMuch.net website(s) and is incorporated into our Terms and Conditions. The HowMuch.net website, and any successor website, and the services offered in connection with such website will collectively be referred to as the “Site.” Please note, if you are a resident of a European Union Member State (“EU Resident”), you are not permitted to use our services.

We encourage you to read this Privacy Policy carefully before and while using our Site or services or transacting business with us. By using our Site, you accept the practices described in this Privacy Policy.

Information we collect about you

In general

When you provide personal information through our Site, the information may be sent to servers located in the United States and other countries around the world. We may collect and store the following personal information:

  • Name, email address, phone number, physical address, (depending on the service used) company information, and any additional contact information you provide;

  • Transactional information based on your activities on the Site, such as bidding information that relates to your account;

  • The home improvement category applicable to your inquiry;

  • The answers you provide in our forms;

  • Community discussions, chats, dispute resolution, correspondence through the Site, and correspondence sent to us; and/or

  • Information from other sources. We may also periodically obtain both personal and non-personal information about you from business partners, service professionals, and other third parties. Examples of information that we may receive include: updated delivery and address information, purchase history, and additional demographic information.

Cookies and other technologies

We use various technologies to collect information from your computer and about your activities on our Site:

  • Information collected automatically. We automatically collect information from your browser when you visit our Site. This information includes your IP address, your browser type and language, access times, standard web log information, the content of any undeleted cookies that your browser previously accepted from us (see “Cookies” below), and the referring website address.

  • Cookies. When you visit our Site, we may assign your computer one or more cookies to facilitate access to our Site and to personalize your online experience. Through the use of cookies, we also may automatically collect information about your online activity on our Site, such as the web pages you visit, the links you click, and the searches you conduct on our Site. Most browsers automatically accept cookies, but you can usually modify your browser settings to decline cookies. 

  • This Site is monitored by one or more third-party monitoring software(s) and may capture information about your visit that will help us improve our quality of service. As of January 14, 2020, we use TrustedForm by ActiveProspect. Under the California Consumer Privacy Act (CCPA), ActiveProspect is classified as a service provider. The data processed by their systems is HowMuch.net’s data. Therefore, their use of your data is limited to the purpose of providing services to us. In regard to the data collected by TrustedForm, they only store the data we ask them to store. Everything else is deleted. They also do not cookie users or share any data with third parties. In the event you request us to delete your data, we consider that a revocation of consent, and you have the right to also ask to remove your data from ActiveProspect’s database by emailing privacy@howmuch.net.  You can also request that ActiveProspect deletes your data by sending an email to support@activeprospect.com

How we use the information we collect about you

You agree that we may use your personal information to:

  • Contact you about the services on our Site, allow other members of the Site to contact you, and inform you about Service Professionals or third-party networks of Service Professionals you have been matched with;

  • Operate the Site and provide customer support;

  • Communicate with you by email, postal mail, telephone and/or mobile devices, or send newsletters about products or services that may be of interest to you;

  • Manage our business;

  • Resolve disputes, collect fees, and troubleshoot problems;

  • Prevent potentially prohibited or illegal activities and enforce our Terms and Conditions;

  • Customize, measure, and improve our services and content;

  • Tell you about service updates based on your communication preferences; and

  • Compare information for accuracy and verify it with third-party sources, such as a “reverse-lookup” ID verification service.

Our disclosure of your information

We will only share your personal information with third parties as outlined within this Privacy Policy. We may share personal information with:

  • Authorized Service Professionals. We will disclose personal information to our authorized Service Professionals who request such information to contact you in connection with a request posted on or through the Site. When services are requested in a geographic location that we do not service, we will need to share your information, including your name, email address, and phone number with a third-party Service Professional network. This third party may use your information to match you with Service Professionals in your area as well as for their promotional purposes.

  • Our independent third-party providers who help with our business operations. For example, we may share your name and email address to an email service provider in order for them to send an email to you on our behalf. Companies that perform services for our Site are prohibited from using this information for their own promotional use.

  • Other third parties to whom you explicitly ask us to send your information or about whom you are otherwise explicitly notified and consent to when using a specific service.

  • Law enforcement or other governmental officials in response to a verified request relating to a criminal investigation or alleged illegal activity. In such events, we will disclose the information relevant to the investigation, such as name, city, state, zip code, telephone number, email address, Screen Name history, IP address, fraud complaints, and bidding and listing history.

  • Other business entities should we plan to merge with or be acquired by that business entity. If Fixr, Inc. DBA HowMuch.net is involved in a merger, acquisition, or sale of all or a portion of its assets, you will be notified via email and/or a prominent notice on our Site of any change in ownership or uses of your personal information, as well as any choices you may have regarding your personal information.

  • Other Situations.

    • We may disclose personal information to respond to legal requirements, enforce our policies, respond to claims that a listing or other content violates the rights of others, or protect anyone’s rights, property, or safety.

For Service Professionals, we may share your business contact information with third parties, including, but not limited to, the business name, address, telephone number, email address, and name(s) of the owner or proprietor of the business.

Any third parties to whom we may disclose personal information may have their own Privacy Policies that describe how they use and disclose personal information. Those policies will govern use, handling, and disclosure of your personal information once we have shared it with those third parties as described in this Privacy Policy. If you want to learn more about their privacy practices, we encourage you to visit the websites of those third parties. These entities or their servers may be located either inside or outside the United States. 

Information you share on the site

For Service Professionals listed on our Site, note that your Screen Name, phone number, and zip code is displayed to other registered users of this Site and is connected to all your activity on the Site. Other people can see your request descriptions, bids, feedback, ratings, and associated comments. Notices sent to other community members about suspicious activity and policy violations on our Site refer to Screen Names and specific requests. So if you associate your name with your Screen Name, the people to whom you have revealed your name will be able to personally identify your activities on the Site.

With respect to users who maintain accounts as Service Professionals, the following information may also be displayed to the public throughout the Site:

  • Company/Business name

  • Phone number

  • Business description

  • Address

  • Submitted certifications, qualifications, and similar information

  • Feedback

If you access our Site from a public or shared computer, certain information about you, such as your Screen Name, activity, or reminders from us, may also be visible to other individuals who use the computer after you.

Using information from the Site

The Site may enable you to share personal information to complete transactions. We encourage you to disclose your privacy practices and respect the privacy of other users. To help protect your privacy, we allow only limited access to other users’ contact and location information to facilitate your transactions. When users are involved in a transaction, they may have access to each other’s name, Screen Name, email address, and other contact and location information.

You agree to use user information only for Fixr, Inc. DBA HowMuch.net transaction-related purposes that are not unsolicited commercial messages or other purposes that a user expressly chooses.

How you can access your information

If you have an online consumer account with us, you have the ability to review and update your personal information online by logging into your account. You can also review and update your personal information by contacting us. More information about how to contact us is provided at the bottom of this Privacy Policy.

You can also choose to have your account disabled by contacting us through one of the methods listed below. After you deactivate your account, you will not be able to sign in to our Site or access any of your personal information. However, you can open a new account at any time. If you deactivate your account, we may still retain certain information associated with your account for analytical purposes and recordkeeping integrity, as well as to prevent fraud, collect any fees owed, enforce our Terms and Conditions, take actions we deem necessary to protect the integrity of our Site or our users, or take other actions otherwise permitted by law. In addition, if certain information has already been provided to third parties as described in this Privacy Policy, retention of that information will be subject to those third parties’ policies.

Your choices about collection and use of your information

Upon your request, we will close your account and remove your personal information from view as soon as reasonably possible, based on your account activity and in accordance with applicable law. To make this request or to ask that we no longer use your information to provide you services, you can cancel your account through your account management settings or by contacting us through one of the methods listed under the Contact Us section at the bottom of this Privacy Policy.

To request the removal of an unauthorized service provider profile, please contact us through one of the methods listed below.

You might also want to keep your account but stop receiving commercial or promotional emails. If you do not wish to receive email offers or newsletters from us, you can opt out of receiving email information from us, except for emails related to the completion of your registration, correction of user data, change of password, and other similar communications essential to your transactions through the services. Do so by using the unsubscribe process at the bottom of any marketing email from us. Although your changes are reflected promptly in active user databases, we may retain all information you submit for a variety of purposes, including, but not limited to, backups and archiving, prevention of fraud and abuse, and analytics.

Cookies

A cookie is a small text file that is stored on a user’s computer for record-keeping purposes. We link the information we store in cookies to help identify you and maintain your signed-in status.

We use both session ID cookies and persistent cookies to help analyze our web page flow, customize our services and content, and promote trust and safety. We use session cookies to make it easier for you to navigate our site. A session ID cookie expires when you close your browser. A persistent cookie remains on your hard drive for an extended period of time. You can remove persistent cookies by following the directions provided by your Internet browser..

We set a persistent cookie to store users’ passwords so that they don’t have to enter it more than once. Persistent cookies also enable us to track and target the interests of our users to enhance their experience on our site.

You are always free to decline our cookies if your browser permits, although doing so may interfere with your use of some or all of our Site or services.

The use of cookies by our service providers is not covered by our Privacy Policy. We do not have access or control over these cookies. Our service providers use persistent cookies to make it easier for you to navigate our Site.

Web beacons

Web beacons (also known as clear gifs, pixel tags, or web bugs) are tiny graphics with a unique identifier, similar in function to cookies, and are used to track the online movements of web users or to access cookies. Unlike cookies, which are stored on the user’s computer hard drive, web beacons are embedded invisibly on the web pages (or in email) and are about the size of the period at the end of this sentence.

Web beacons may be used to deliver or communicate with cookies, count users who have visited certain pages, and understand usage patterns. We also may receive an anonymous identification number if you come to our Site from an online advertisement displayed on a third-party website.

No spam, spyware, or spoofing

Neither HowMuch.net nor our users tolerate spam. Make sure to set your notification preferences so that we communicate with you as you prefer. We will send you service-related announcements on rare occasions when it is necessary to do so. For instance, when you first register to use our Site, we will send you an email requiring you to confirm your account activation.

If you register to use our Site as a service provider, you will receive email alerts from other users requesting your services. If you register to use our Site to request the service of a service professional, third parties may contact you to offer their services.

Generally, you may not opt-out of these communications. If you do not wish to receive them, you have the option to deactivate your account.

You are not licensed to add other users, even a user with whom you’ve engaged in a transaction, to your mailing list (email or physical mail) without their express consent. To report HowMuch.net-related spam or spoof emails, please forward the email to spam@howmuch.net. You may not use our communication tools to send spam or otherwise send content that would violate our Terms and Conditions. We may scan and filter messages to check for spam, viruses, phishing attacks, and other malicious activity or illegal or prohibited content, but we do not permanently store messages sent through these tools.

Mobile Messaging Service

If you elect to register as a service professional, HowMuch.net provides you the option of receiving text messages through a mobile phone number Text Messaging Service (SMS) (“SMS Service”). These text message alerts allow HowMuch.net to notify you of service opportunities in your geographical area and for services for which you have indicated an interest in performing. The information contained or transmitted between HowMuch.net and you via SMS will not be provided, sold, licensed, rented, assigned, or disclosed to third parties, except as required by law. Nor will we use your phone number to initiate a call or SMS text message to you without your express prior consent. Your wireless carrier and other service providers also collect data about your SMS Service usage, and their practices are governed by their own privacy policies.

HowMuch.net collects the mobile phone number you use to send us a text message and the content of the messages sent between you and HowMuch.net. When you send a text message to HowMuch.net, we log the incoming phone number, wireless provider associated with the number, and date and time of the transaction. HowMuch.net uses this data to analyze the message traffic in order to operate, develop, and improve our SMS Service.

Account protection

Your password is the key to your account. Use unique numbers, letters, and special characters, and do not disclose your password to anyone. If you share your password or your personal information with others, remember that you are responsible for all actions taken from  your account. If you lose control of your password, you may lose substantial control over your personal information and may be subject to legally binding actions taken on your behalf. Therefore, if your password is compromised for any reason, notify us immediately and change your password. 

Disqus comment management

Based on our legitimate interests in an efficient, secure, and user-friendly commentary system for our blog pages, we use the comment management service Disqus. In order to take advantage of its features, users can log in using their own Disqus user account or existing social media accounts (e.g., OpenID, Facebook, Twitter, or Google). The user credentials are obtained from the platforms through Disqus. It is also possible to use the Disqus comment feature as a guest without creating or using user accounts with Disqus or any of the social media providers listed.

HowMuch.net embeds Disqus with its features on our website . However, users enter into a direct contractual relationship with Disqus, in which Disqus processes users’ comments and acts as point of contact for any deletion of users’ data. Please refer to the Disqus privacy policy, https://help.disqus.com/terms-and-policies/disqus-privacy-policy, in which Disqus informs users that they save the comment content, as well as store the IP address of the commenter and the timestamp of submission. Disqus also saves cookies on users’ computers and may use them to display advertising. However, users may object to the processing of their data to display ads by clicking on the “opt-out” button included on this page: https://disqus.com/data-sharing-settings/.

HowMuch.net reserves the right to delete comments if their content violates the HowMuch.net Terms and Conditions. In addition, we reserve the right to stop or remove the comment function and the associated comments on any article, at any time.

Data retention

We will retain your information for as long as your account is active or as needed to provide you services. We retain personal information from closed accounts to comply with the law, prevent fraud, collect any fees owed, resolve disputes, troubleshoot problems, assist with any investigations, enforce our Terms and Conditions, and take other actions otherwise permitted by law.

Links to other sites

Our Site contains links from and to other websites. Please be aware that the HowMuch.net Site is not responsible for the privacy practices of such other websites. We encourage our users to be aware of this when they leave our Site and to read the privacy statements of every website that collects personally identifiable information (PII). This Privacy Policy applies solely to information collected by the HowMuch.net Site.

Security

Your information is stored on our servers, which may be located within or outside the United States. We treat data as an asset to be protected and use a number of tools to protect your personal information against unauthorized access and disclosure. However, third parties may unlawfully intercept or access transmissions or private communications, and other users may abuse or misuse your personal information that they collect from the Site. Therefore, although we strive to protect your privacy, we do not promise, and you should not expect, that your personal information or private communications will always remain private.

Third parties

Except as otherwise expressly included in this Privacy Policy, this document addresses only the use and disclosure of information we collect from you. If you disclose your information to others, whether they are users on our Site or other sites throughout the Internet, different rules may apply to their use or disclosure of the information you disclose to them. We do not control the privacy policies of third parties, and you are subject to the privacy policies of those third parties where applicable.

Children

The services are not directed to children under 13, and we do not knowingly collect or store any personally identifiable information (PII) about persons under the age of 13. If we learn that we have collected PII of a child under 13, we will make commercially reasonable efforts to delete such information from our files. If you are under the age of 13, please do not submit any personal information through our Site. 

Visiting our websites from outside the United States

This Privacy Policy is intended to cover collection of information on our Site from residents of the United States. If you are visiting our website from outside the United States, please be aware that your information may be transferred to, stored, and/or processed in the United States where our servers are located and our central database is operated. The data protection and other laws of the United States and other countries might not be as comprehensive as those in your country. By using our services, you understand that your information may be transferred to our facilities and those third parties with whom we share it as described in this Privacy Policy.

Changes to this Privacy Policy

We will occasionally update this Privacy Policy to reflect changes in our practices and services. When we post changes to this Privacy Policy, we will revise the “last updated” date at the top of this Privacy Policy. If we make any material changes in the way we collect, use, and/or share your personal information, we will notify you by posting the updated Privacy Policy on our Site, denoting that the policy has been updated. Under Nevada law, Nevada residents may opt out of the sale of certain “covered information” collected by operators of websites or online services. However, if you would like to be notified if we decide in the future to sell personal information covered by the Act, please use nevadaprivacy@howmuch.net to provide your name and email address. You are responsible for updating any change in your email address by the same method, and we are not obligated to cross-reference other emails you may have otherwise provided us for other purposes. We will maintain this information and contact you if our plans change. At that time, we will create a process for verifying your identity and providing an opportunity to verified consumers to complete their opt-out. Your request must include, at a minimum, your telephone number and name. If you have multiple telephone numbers, please include all numbers that you would like included in our Do-Not-Call List in your request. We do not “sell” personal information that we collect from you, in accordance with the definition of “sell” in the CCPA, and will treat personal information we collect from you as subject to a do-not-sell request. There is not yet a consensus as to whether third-party cookies and tracking devices associated with our Site may constitute a “sale” of your PI as defined by the CCPA. You can exercise control over browser-based cookies by adjusting the settings in your browser. We do not represent that these third-party tools, programs, or statements are complete or accurate.

Some browsers have signals that may be characterized as do-not-track signals, but we do not understand them to operate in that manner or to indicate a do-not-sell expression by you. So, we currently do not recognize these as a do-not-sell request. We understand that various parties are developing do-not-sell signals, and we may recognize certain such signals if we conclude such a program is appropriate.

California Consumers have the right to exercise the privacy rights under the CCPA. California Consumers may exercise these rights via an authorized agent who meets the agency requirements of the CCPA. Any request you submit to us is subject to an identification and residency verification process (“Verifiable Consumer Request”). We will not fulfill your CCPA request unless you have provided sufficient information for us to reasonably verify you are the Consumer about whom we collected PI. Please follow the instructions below and respond to any follow up inquiries we may make.

Some personal information we maintain about Consumers is not sufficiently associated with enough personal information about the Consumer for us to be able to verify that it is a particular Consumer’s personal information (e.g., clickstream data tied only to a pseudonymous browser ID). As required by the CCPA, we do not include that personal information in response to Verifiable Consumer Requests. If we cannot comply with a request, we will explain the reasons in our response.

We will make commercially reasonable efforts to identify Consumer PI that we collect, process, store, disclose, and otherwise use and to respond to your California Consumer privacy rights requests. We will typically not charge a fee to fully respond to your requests, but we may charge a reasonable fee, or refuse to act upon a request, if your request is excessive, repetitive, unfounded, or overly burdensome.

  • The categories of PI we have collected about you.

  • The categories of sources from which we collected your PI.

  • The business or commercial purposes for our collecting or selling your PI.

  • The categories of third parties to whom we have shared your PI.

  • The specific pieces of PI we have collected about you.

  • A list of the categories of PI disclosed for a business purpose in the prior 12 months, or that no disclosure occurred.

  • A list of the categories of PI sold about you in the prior 12 months, or that no sale occurred. If we sold your PI, we will explain:

    • The categories of your PI we have sold.

    • The categories of third parties to which we sold PI, by categories of PI sold for each third party.

You have the right to make or obtain a transportable copy, no more than twice in a twelve-month period, of your PI that we have collected in the period that is twelve months prior to the request date and are maintaining.

Please note that PI is retained by us for various time periods, so we may not be able to fully respond to what might be relevant going back twelve months prior to the request.

Except to the extent we have a basis for retention under CCPA, you may request that we delete your PI that we collected directly from you and are maintaining. Note also that we are not required to delete your PI that we did not collect directly from you.

You may alternatively exercise more limited control of your PI by instead opting out of marketing emails by emailing privacy@howmuch.net.

We will not discriminate against you in a manner prohibited by the CCPA because you exercise your CCPA rights. However, we may charge a different price or rate, or offer a different level or quality of goods or services, to the extent that doing so is reasonably related to the value of the applicable data. In addition, we may offer you financial incentives for the collection, sale and retention, and use of your PI as permitted by the CCPA that can, without limitation, result in reasonably different prices, rates, or quality levels. The material aspects of any financial incentive will be explained and described in its program terms. Please note that participating in incentive programs is entirely optional, you will have to affirmatively opt-in to the program, and you can opt-out of each program (i.e., terminate participation and forgo the ongoing incentives) prospectively by following the instructions in the applicable program description and terms. We may add or change incentive programs and/or their terms by posting notice on the program descriptions and terms linked to above, so check them regularly.
